HAPPY FIDDLER CONDOMINIUM ASSOCIATION VACATION RENTAL AGREEMENT & HOUSE RULES

This Vacation Rental Agreement (“Agreement”) is a legally binding contract between the renter identified in the reservation (“Guest,” “You,” or “Renter”) and Happy Fiddler Condominium Association and/or its designated agent or property manager (“Management,” “We,” or “Us”), acting as agent for the individual property owner (“Owner”).

By making a reservation, submitting payment, occupying the Property, or allowing any other person to occupy the Property, Guest acknowledges that Guest has read, understands, and agrees to be bound by all terms of this Agreement.

1. PROPERTY & OCCUPANCY

The reservation grants Guest a temporary license to occupy the assigned condominium unit (“Property”) solely for lodging purposes.

Overnight occupancy is limited to six (6) people maximum, regardless of age or sleeping arrangements. If a unit’s listing specifies a lower limit, that number applies. More than four daytime visitors at once requires prior office approval and will be monitored.

Exceeding occupancy, hosting unauthorized visitors, or misrepresenting occupants constitutes a material breach of this Agreement and may result in immediate termination without refund.

2. AGE REQUIREMENT & RESPONSIBILITY

The primary renter must be at least twenty-five (25) years of age and must occupy the Property for the entire stay.

At least one parent or legal guardian is required for every three guests under the age of 25.

Reservations made under false pretenses, including but not limited to “third-party bookings,” are void. Management may deny check-in or terminate occupancy without refund.

The named Guest is fully responsible for the conduct of all occupants and visitors.

3. PAYMENT TERMS

A  reservation deposit of twenty-five percent (25%) of the total rental charges is due at the time of booking and is required to secure the reservation.

The remaining balance, including all rent, taxes, fees, and applicable charges, is due thirty (30) days prior to arrival and will be automatically charged to the credit card on file unless paid earlier.

For reservations made within thirty (30) days of arrival, full payment is due immediately at the time of booking.

By providing a credit card, Guest authorizes Management to charge the card on file for all scheduled payments and any post-departure charges, including damage, missing items, excessive cleaning, fines, or violations.

No security deposit is required.

Failure to make payments when due constitutes a material breach of this Agreement and may result in cancellation of the reservation without refund.

All payments are non-refundable except as expressly provided in the Cancellation Policy below.

4. CANCELLATION & REFUND POLICY

All cancellations must be submitted in writing.

If Guest cancels:

  • More than ninety (90) days prior to arrival: Guest receives the reservation deposit and any additional amounts paid will be refunded.
  • Within ninety (90) days prior to arrival the deposit is non-refundable.
  • Within thirty (30) days of arrival or after check-in: All amounts paid, including the nonrefundable deposit and full balance, are non-refundable.

No refunds will be issued for late arrivals, early departures, evictions or termination for cause, weather conditions or forecasts, transportation failures, or personal emergencies.

TRAVEL INSURANCE IS STRONGLY RECOMMENDED.

5. CHECK-IN / CHECK-OUT

Check-in time is 4:00 PM. Check-out time is 10:00 AM. Late check-outs may result in additional charges up to a full day’s rent. Keys must be returned as instructed. Failure to return keys may result in rekeying charges.

6. USE RESTRICTIONS

The Property may be used for residential lodging purposes only.

The following are strictly prohibited: parties or events, excessive noise or disturbances, underage drinking, smoking inside any unit, pets, grilling on balconies or decks, commercial use, filming or photography without written approval, and illegal activity of any kind.

Violation of these rules may result in immediate eviction without refund.

7. CLEANING, CONDITION & DAMAGE

Guest agrees to keep the Property in a clean and sanitary condition and to report any issues within 24 hours of arrival.

Guest is financially responsible for damage, missing items, excessive cleaning, stained linens or towels, and furniture rearrangement or misuse.

8. MAINTENANCE & INTERRUPTIONS OF SERVICES

Management will make reasonable efforts to maintain the Property and amenities. No refunds or credits will be given for temporary failures of utilities, internet, appliances, pool or common areas, or for construction noise or nearby activity.

9. RIGHT OF ENTRY

Management and Owner reserve the right to enter the Property for inspection, maintenance, repairs, or in emergencies.

10. TERMINATION OF OCCUPANCY

Management reserves the absolute right to deny check-in or terminate occupancy if Guest or any occupant violates this Agreement. No refunds will be issued in such cases.

11. HURRICANES & FORCE MAJEURE

If a mandatory evacuation is ordered by local authorities for the Property, unused nights will be refunded.

No refunds will be issued for voluntary evacuations or weather forecasts.

Management is not responsible for failure to perform due to events beyond its control, including but not limited to acts of God, storms, pandemics, government orders, utility failures, or property damage.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Management, the Association, and Owner shall not be liable for any injury, loss, damage, or death to persons or property, regardless of cause.

Guest’s maximum recovery, if any, shall not exceed the total amount paid for the reservation.

13. INDEMNIFICATION

Guest agrees to indemnify, defend, and hold harmless Management, the Association, and Owner from any claims, damages, losses, liabilities, or expenses arising from Guest’s occupancy or use of the Property.

14. PERSONAL PROPERTY

Management and Owner are not responsible for lost, stolen, or forgotten items.

15. ASSIGNMENT & SUBLETTING

Subletting or assignment of this reservation is strictly prohibited and will result in immediate termination without refund.

16. CHARGE DISPUTES

Guest agrees not to dispute or charge back any charges that are authorized under this Agreement. Fraudulent chargebacks constitute breach of contract.

17. GOVERNING LAW & VENUE

This Agreement shall be governed by the laws of the State of Florida. Venue shall lie in Pinellas County, Florida.

18. SEVERABILITY

If any provision of this Agreement is found invalid, the remaining provisions shall remain in full force and effect.

19. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions or representations.

20. QUIET HOURS & FINES (HOUSE RULES ADDENDUM)

Quiet Hours: 10:00 PM – 8:00 AM daily.

Fine Schedule:

  • Noise / party disturbance: $500 per incident
  • Smoking in unit: $750 + remediation
  • Pet violation: $750 + remediation
  • Late checkout (unapproved): up to one night’s rent
  • Lost keys / rekeying: actual cost
  • Excessive cleaning or damage: actual cost plus $150 administrative fee

Repeated or serious violations may result in immediate eviction without refund.

21. OWNER-SPECIFIC RULES

Certain units may have additional owner-specific rules or restrictions disclosed at booking or posted in the unit. Those rules are incorporated into this Agreement and are enforceable as if fully stated herein.

22. ELECTRONIC SIGNATURES & COUNTERPARTS

This Agreement may be executed electronically and in counterparts. Electronic acceptance, digital signatures, and checkbox acceptance shall be deemed legally binding.

23. TRAVEL INSURANCE DISCLAIMER

THE HAPPY FIDDLER CONDOMINIUMS DOES NOT PROVIDE TRIP INSURANCE OR PROTECTION COVERAGE. WE STRONGLY RECOMMEND THAT GUESTS PURCHASE TRAVEL INSURANCE FROM A THIRD-PARTY PROVIDER TO COVER LOSSES RESULTING FROM TRIP CANCELLATIONS, INTERRUPTIONS, DELAYS, MEDICAL EMERGENCIES, OR OTHER UNFORESEEN CIRCUMSTANCES.

BECAUSE ALL PAYMENTS BECOME NON-REFUNDABLE ONCE THE CANCELLATION WINDOW BEGINS, GUESTS ARE STRONGLY ADVISED TO PURCHASE TRAVEL INSURANCE TO PROTECT AGAINST UNEXPECTED EVENTS, INCLUDING ILLNESS, WEATHER, TRAVEL DELAYS, OR OTHER INTERRUPTIONS. COMMONLY USED PROVIDERS INCLUDE;

GENERALI GLOBAL ASSISTANCE (HTTPS://WWW.GENERALITRAVELINSURANCE.COM).

TRAVEL INSURANCE IS OPTIONAL AND IS PURCHASED DIRECTLY BY THE GUEST FROM THE PROVIDER OF THEIR CHOICE. GUESTS ARE SOLELY RESPONSIBLE FOR REVIEWING COVERAGE OPTIONS AND SECURING A POLICY THAT MEETS THEIR NEEDS.

BY CONFIRMING YOUR RESERVATION, YOU ACKNOWLEDGE AND AGREE THAT REFUNDS ARE GOVERNED SOLELY BY THE STATED CANCELLATION POLICY AND THAT NO EXCEPTIONS WILL BE MADE.
